Health & Welfare Plan Compliance

Employee Meeting

Like retirement plans, health & welfare plans are subject to the requirements of ERISA and the Code. In addition, health plans must comply with other laws, including COBRA, HIPAA, and the Affordable Care Act (ACA). Our attorneys are experienced in assisting employers with the requirements of these laws, including:

  • Plan document requirements (under ERISA and, in the case of cafeteria plans, the Code)
  • Reporting and disclosure requirements including Form 5500 filing
  • Non-discrimination testing requirements applicable to self-insured health plans, cafeteria plans, and certain HSAs
  • Summary plan descriptions (SPDs) and summaries of material modifications (SMMs)
  • Summaries of Benefits and Coverage (SBC) and advance notices of mid-year changes
  • Special claims procedures for health plans
  • Trust requirements for plan assets
  • Qualified medical child support orders (QMCSOs)
  • Employer mandate requirements under the ACA including reporting and coverage
  • Notice and other requirements of COBRA
  • HIPAA privacy, including policies, procedures, notices, and business associate agreements
